General Data Protection Regulation Chart

The Danem People recruitment agency is concerned about protecting the privacy and data of its contacts (users of its website and internet platform, contacts made within the framework of strategic consulting and recruitment mandates, professional meetings, partnerships, services, applications, etc.). Thus, Danem People ensures that it adopts and complies with a data processing policy that complies with the regulations in force. In this respect, Danem People complies with the applicable European law on the protection of personal data, and in particular the European General Regulation on the Protection of Personal Data n°2016/679 of 27 April 2016 (known as "GDPA"), as well as all the rules of national law taken in application of the latter, on a subsidiary basis, and which may be applicable depending on the case. The purpose of this Personal Data Protection Charter (the "Charter") is to inform in a clear, simple and complete manner the persons concerned ("you" or "your") about the way in which Danem People, in its capacity as data controller, collects and uses personal data concerning you ("the personal data") and the means you have at your disposal to control this use and exercise your rights relating thereto.

 

On what occasions is your personal data collected?

 

Danem People may collect your personal data in the context of strategic consulting and recruitment mandates, professional meetings, files, partnerships, applications, your visit to our premises, your use of our websites and web pages and your use of our online services. Declarative personal data are those that you provide via forms, whether they are dematerialised on the websites, in paper format or in response to questions asked to you by partners or associates of the firm. Danem People considers the principles of data minimisation, data protection from the design stage and default data protection. As a result, relevant, adequate and limited information is collected only to the extent necessary for the purposes for which it is processed. Mandatory declarative personal data is indicated by a "*" sign on the collection medium. Apart from these cases, you are free to provide all or part of your personal data or not.

Your personal data is processed by Danem People in the cases permitted by the applicable regulations, and in particular under the following conditions:

Your personal data is collected for specific, explicit and legitimate purposes.

Who are the recipients of your personal data?

 

As your personal data is confidential, only persons duly authorised by Danem People can access your personal data, without prejudice to their possible transmission to bodies entrusted with a control or inspection mission in accordance with the applicable regulations. All persons having access to your personal data are bound by an obligation of confidentiality. These persons include the partners and associates authorised within the firm. Our service providers may also process personal data that is strictly necessary for the performance of the services we entrust to them (electronic distribution, logistics, etc.). In the event of recourse to service providers located outside the European Union, Danem People undertakes to check that appropriate measures have been put in place to ensure that your personal data benefits from an adequate level of protection (in particular thanks to standard contractual clauses of the European Commission, Internal Company Rules or the Data Protection Shield put in place between the European Union and the United States).

 

How do we protect the confidentiality of your personal data ?

 

Danem People takes care to protect and secure your personal data to ensure their confidentiality and prevent them from being distorted, damaged, destroyed or disclosed to unauthorised third parties. Where the disclosure of data to third parties is necessary and authorised, Danem People ensures that these third parties guarantee the data concerned the same level of protection as that offered to them by Danem People, and requires contractual guarantees so that, in particular, the data is processed exclusively for the purposes to which you have previously agreed, with the required confidentiality and security. Danem People implements technical and organisational measures to ensure that personal data is kept securely for the time necessary to fulfil the purposes in accordance with applicable law. Although Danem People takes reasonable steps to protect your personal data, no transmission or storage technology is completely infallible. In accordance with the applicable European regulations, in the event of a proven breach of Personal Data that is likely to create a high risk for the rights and freedoms of the persons concerned, Danem People undertakes to communicate this breach to the competent supervisory authority and, where required by the said regulations, to the persons concerned (individually or generally as the case may be). Without prejudice to the foregoing, it is your responsibility to exercise caution to prevent any unauthorised access to your personal data and to your terminals (computer, smartphone, tablet, etc.). In addition, the firm's website may provide links to third party websites that may be of interest to you. Danem People has no control over the content of these third party sites or over the practices of these third parties with regard to the protection of personal data that they may collect. Consequently, Danem People declines all responsibility for the processing by these third parties of your Personal Data, which is not subject to this Charter. It is your responsibility to inform yourself about the personal data protection policies of these third parties.

 

How long is your personal data kept?


Danem People keeps your personal data for the time necessary for the fulfilment of the pursued purposes, subject to the legal possibilities of archiving, obligations to keep certain data, and/or anonymization. In particular, we apply the following retention periods for these few broad categories of personal data:

  • Personal data of customers/prospects/suppliers: as long as the user is active and at the latest 3 years after the last contact with the user.
  • Personal data of candidates (recruitment and HR consultancy): as long as necessary to process the application and, in case of negative outcome, 3 years after the last contact (unless the candidate agrees to a longer period).

Applicable law and competent court

 

This Charter is subject to French law. In the event of a dispute and in the event that an amicable agreement cannot be reached, the competent courts will be those of the Paris Court of Appeal, notwithstanding plurality of defendants or appeal in warranty.
